1. Acceptance of Terms

1.1. This "website" (Website) www.mybusiness.com, hereinafter referred to as MYBUSINESS, owned by Media Invest Lda, a company based in Lisbon, registered in Portugal with Tax Number PT514274093, is available, provided they are the "Terms of Use" presented below are complied with by the user. By accessing this "website", the user is informed and aware that the use of this "website" implies acceptance of the following "Terms of Use" and that he may not use the same in a manner contrary to these "Terms of Use" or for any purpose that is illegal.

1.2. MYBUSINESS will periodically update the content of the website and the "Terms of Use", as well as the Privacy Policies governing its use, at any time, without notification of past, present and occasional users. To access the most up-to-date version of the "Terms of Use", simply click on the "Terms of Use" hypertext link located at the bottom of MYBUSINESS. If you do not accept these Terms of Use, please do not use the "website" MYBUSINESS.

1.3. The User may not use the MYBUSINESS Services or accept the "Terms of Use" if:

• I. You are not of legal age to enter into an agreement with legal effect with Media Invest Lda;
• II. You are a person with restrictions on receiving Services imposed by the laws where you are resident or from which you use the Services.

1.4. Before proceeding, the user must print or save a copy of the "Terms of Use".

2. Provision of Services by MYBUSINESS

2.1. MYBUSINESS may, at any time, temporarily or permanently withdraw the MYBUSINESS "website", due to technical problems or failures or by decision thereof, without the need to communicate to the user, accepting that he is not entitled to any type of compensation for these facts.

2.2. You acknowledge and accept that if MYBUSINESS deactivates your account, you may be prevented from accessing the services or data generated by it. The user may request the transfer of personal or business data that were entered by him up to 6 months after the deactivation date of the account, and to do so, communicate by letter to the address indicated below.

2.3. MYBUSINESS develops its activity in the IT area, managing, creating and maintaining content and commercial spaces on the Internet in areas related to Internet marketing and advertising, owning and administering a portal, directory and newsletter, dedicated to the dissemination of information, promotion of products, services and business opportunities relating to the entire range of products directly related to advertising and marketing of companies and services, with the web domain www.mybusiness.com. MYBUSINESS has the legitimacy to analyze and decide the presence of a certain advertiser on MYBUSINESS.

3. Use of the Services by the User

3.1. MYBUSINESS services are available to the user under the "MYBUSINESS Beta Program", which is an experimental free to use cloud service.

3.2. The user undertakes not to practice or develop any offensive, harmful or intrusive conduct or practice likely to jeopardize the protected rights or interests of MYBUSINESS, being held responsible, bearing all costs associated with unlawful actions attributed to him. Among others, they are considered as unlawful actions:

• I. If the user manages to access the Business Zone, without our consent and in an unauthorized manner;
• If the user tries to test and assess the vulnerability of the system, jeopardizing the installed security;
• III. If the user installs or tries to install a virus on the portal;
• IV. Sending unsolicited emails that include promotions or advertising for products or services;
• V. If the user uses any of the services provided by MYBUSINESS for a purpose other than that proposed by the website.

3.3. In case of dispute, regarding the express "Terms of Use", Portuguese law shall apply, and the Judicial Court of the District of Lisbon is exclusively competent for its assessment.

3.4. The MYBUSINESS Beta Program (MBP) is a digital service available free-to-use for entrepreneurs and busineses. The program has 2 objectives:

• I. Provide users digital tools and digital resources to enable them to become more Digital;
• II. Provide the MYBUSINESS development and management teams with necessary experience to develop an innovative service cloud for the digitalization of businesses.

3.5. The MYBUSINESS Beta Program and MYBUSINESS website is currently under development phase and therefore is not being offred as a commercial product. During the development period we will offer the service to users at their own risk.

3.6. The MYBUSINESS Beta Program gives no guarantee of level of service or support to the users, besides standard RGPD legal obligations of a normal web site.

3.7. The MYBUSINESS platform will comply to the best of its abilities to a secure communication and data security policy. For that media Invest will:

• never store you password or other sensitive data on any server;
• ensure that the best practices for data comunication and data privacy are followed, in order to guarantee users the best security;
• never share your public or private data with other organizations. On the other hand, by registing to MYBUSINESS Beta Program via an affiliated network, the data will also be available to that network accordingly to teir data policy.
• will respect data ownership of the user and will eliminate that data if requested to.

4. Account Security and User Passwords

4.1. You agree and understand that you will be responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services.

4.2. Therefore, you agree that you will be solely responsible to MYBUSINESS for all activities that occur under your account.

4.3. If you become aware of any unauthorized use of your password or account, you agree to notify MYBUSINESS immediately using the form of contact.

5. Content on the Services

5.1. The user understands that full responsibility for all information (such as: data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) to which he may have access, as part of the Services or through the use of the Services, is of the person who originated the content. All this information is called “Content”.

5.2. You should be aware that Content presented to you as part of the Services, including, without limitation, advertisements on the Services and Sponsored Content on the Services, may be protected by intellectual property rights that are owned by the sponsors or advertisers who provide such Content to MYBUSINESS (or by other persons or companies on your behalf). You may not copy, reproduce, alter, modify or create derivative works based on this Content (in whole or in part), unless you have been specifically authorized to do so, through a separate contract with MYBUSINESS. com or by the owners of such Content.

5.3. MYBUSINESS may, at any time, terminate the contract with the user, without prejudice to the law, if:

• I. You have violated any provision of the Terms (or have acted in a way that clearly shows that you do not intend or cannot comply with the terms of the Terms);
• II. The partner with whom MYBUSINESS offered the Services to the user has terminated its relationship with MYBUSINESS or has ceased to offer the Services to the user;
• III. MYBUSINESS is transitioning to a situation where it no longer provides the Services to users in the country in which you are resident or from which you use the Services;
• IV. The provision of the Services to the MYBUSINESS user is no longer, in the opinion of Media Invest, commercially viable.

5.4. Newsletter subscription can be managed through the newsletter channel. In this same channel, you will find instructions on how to unsubscribe.

5.5. It is also possible to unsubscribe from the newsletter by sending a message via the contact form.

6. Means of Contact

6.1. All information related to MYBUSINESS's data processing or privacy policy must be requested through the contact form or in writing, addressed to the Data Protection Officer of MYBUSINESS, to the following address: Rua Abel Manta, 6, 6ºC, 2675-614 Odivelas, Portugal.

6.2. Any communications of a legal nature must be communicated exclusively by letter to the address mentioned in the previous paragraph.

Privacy Policy

1. Who we are

This "web site" (www.mybusiness.com), hereinafter referred to as MYBUSINESS, is owned by Media Invest Lda, a company based in Lisbon, registered in Portugal with Tax Number PT514274093.

Media Invest manages the website and all its contents, unless expressly stated otherwise.

2. Personal Data

4. Data collected by electronic processes

Comments

When visitors leave comments on the MyBusiness site, the data in the comments form, as well as the IP address and browser user agent, are saved to help with spam detection.

Multimedia

Images submitted for publication on the website may contain embedded geolocation data (EXIF GPS). Visitors can download and extract geolocation data from the site's images.

Contact Forms

When the contact form is used, we ask for the Name and Email, to respond to the user. You may also be asked for a Telephone Number to speed up this response. Your indication is optional.

The data collected is processed and stored in strict compliance with the legislation on the protection of personal data, and this information will only be kept for the period necessary to support the user and will not be used for marketing purposes.

Cookies

6. How long are your data retained

If you leave a comment, the comment as well as its metadata are saved indefinitely. This is so that you can automatically recognize and approve any comments that follow, rather than putting them in a moderation queue.

For users who register on our site, we store the personal information you provide in your user profile. All registered users can view, edit, or delete their personal information at any time (with the exception of not being able to change their username). Site administrators can also view and edit this information.

The data collected through the form is deleted every six months. However, the data referring to the sending of newsletters or the dissemination of activities and partnerships will be kept until its deletion is requested.

The data provided to MYBUSINESS are treated in accordance with the RGPD, being treated lawfully, loyally and transparently. They are collected for specific, explicit and legitimate purposes and will not be further processed in a way that is incompatible with those purposes.  The information requested is adequate, pertinent and limited to the purposes for which it is treated.
